On December 3, 2025 in a profoundly anti-democratic move, Poland's Constitutional Tribunal (TK) ruled that the Communist Party of Poland (KPP) violates the country’s constitution.

The Brazilian Communist Party – PCB – vehemently condemns the attempts to outlaw the Communist Party of Poland and communist ideas, perpetrated by the bourgeois governments and their lackeys in the Polish judiciary.


As reported by our Polish comrades, this time, on December 3rd, the Constitutional Court, at the request of the President of Poland, ruled that the objectives and activities of the Communist Party are incompatible with the Polish Constitution. Furthermore, communist ideas have been persecuted in Poland for some time: following the same modus operandi also adopted by the anticommunist right in the Czech Republic, amendments were introduced to the Polish Penal Code in October 2023. These amendments included: the prohibition of communist ideology and symbols, their unacceptable equation with fascism, and prison sentences of up to 3 years for communist activities.


The Brazilian Communist Party is very familiar with the insanity of anticommunist legislation. In our century-long existence, we have spent more than half of that time in illegality, especially during the 1964-1985 corporate-military dictatorship, in strict clandestinity. Recently, even here in Brazil, spokespeople of the neofascist far-right have attempted to propose the criminalization of communism.


The PCB condemns in the strongest terms the outlawing of the CPoP, and expresses its full and unconditional solidarity with the comrades of the Communist Party of Poland.

The Communist Party of the Workers of Spain (PCTE) expresses its solidarity to the Communist Party of Poland (KPP), recently banned by the Constitutional Court at the request of the country's President, Karol Nawrocki.


This court decision is the culmination of decades of attacks against the KPP, its newspaper Brzask, and communist symbols by the Polish bourgeois forces — aiming at dismantling the workers' opposition to the capitalist policies that have hit workers so hard in this country.


Such policies are today particularly focused on the military rearming and the preparation of the imperialist war, for which the member States of the European Union have made nationalism and anti-communism their official ideology. The KPP is the last victim of the need of the European bourgeoisie to repress or co-opt the communist and workers' parties.


The PCTE notes that anti-communist persecution is fought by strengthening of the political, ideological, and organizational work, so that communists are capable of struggling under all the possible conditions. Bans never prevented communists from fulfilling their mission, and this is not an exception today.


Anti-communism will fail!



On November 6th 2025, the far-right Polish President Karol Nawrocki petitioned the Constitutional Court to outlaw the Communist Party of Poland. On 3 December, the Constitutional Court ruled that “the party’s objectives are incompatible with the Polish Constitution, which prohibits the existence of political parties that base their program on totalitarian ideologies such as Nazism, Fascism and Communism.”. The judge of the court, Krystyna Pawłowicz stated that the communist ideology of the Communist Party of Poland "goes against the fundamental human values and traditions of European and Christian civilization" (sic).


At present, the Communist Party of Poland is fighting to prevent its illegalization, something that is not new and that has been happening in the last ten years. The Court is not recognized as a legal body by the current government and its verdicts are considered illegal, so they are not published or applied by the authorities. The decision of the court responsible for the registration of political parties, which may or may not outlaw the Party, is thus expected.


Faced with this situation, Communists of Catalonia want to state the following:


This persecution transcends Poland and is part of an anti-communist hysteria campaign that runs throughout Europe, either through the different resolutions that equate communism with Nazism by the European Union, or the persecution suffered by the Communists in the Czech Republic, Poland, Ukraine, as well as in other eastern countries.


This is not a persecution of the Communists, but an attack on fundamental rights and freedoms and on democracy itself.


The Polish state is the least suitable for giving democratic lessons to anyone. It is well-known the deeply racist and xenophobic statements of some of its leaders, the attacks on the fundamental rights of women, the lack of independence of its judiciary, just as Poland is known for being a country that welcomes Nazi-fascist groups from all over the continent, and allows them to demonstrate through the centre of Warsaw with impunity.


Finally, we want to show all our solidarity and warmth to the comrades of the Communist Party of Poland in their fight against illegalization.

Ante la consideración del Partido Comunista Polaco como una organización inconstitucional por parte del Tribunal Constitucional de ese país, los abajo firmante, Partidos y las Organizaciones que aspiramos a la Sociedad sin clases, manifestamos nuestra solidaridad con la militancia comunista polaca y la más firme condena de la decisión de los tribunales burgueses polacos que allana el camino para la próxima ilegalización del Partido Comunista.


Entendiendo siempre la ilegalización de cualquier Partido Comunista en el marco de la lucha de clases, la decisión del alto tribunal polaco, es otro paso másque se da en el seno de la UE en contra de las ideas comunistas hacia el objetivo final de la ilegalización y persecución del Comunismo, en un creciente contexto de criminalización de su militancia que denunciamos y nos comprometemos a combatir.


Al mismo tiempo, junto al progresivo avance de un fascismo que, por su propio carácter de clase y razón de ser, es absolutamente funcional a los intereses del Capitalismo y el perro de presa preferido en momentos de crisis como el actual, este proceso de represión al Comunismo en el seno de la UE, responde, principalmente, a las exigencias que impone la continuidad de la guerra que la OTAN libra contra Rusia en Ucrania y la voluntad manifiesta de los dirigentes de la UE de mantenerla y extenderla por encima de cualquier otra consideración.


Las políticas belicistas de una UE absolutamente subsumida a los intereses de la OTAN y al liderazgo de los EE.UU, determinan un escenario de recortes en derechos sociales, laborales y civiles, orientados a enfrentar la confrontación en defensa de sus derechos e intereses de un movimiento obrero y popular que, denunciando la guerra imperialista y las políticas anti obreras de los diversos gobiernos europeos, ya empieza a dar señales de su creciente capacidad de organización y movilización, desarrollando exitosas huelgas y luchas en una gran parte de países de Europa.


La esencia anticomunista de la UE, marcada por su propio carácter de clase, pero fundamentada en una legislación como la Resolución 1481/2006 de la Asamblea Parlamentaria del Consejo de Europa y la Resolución del Parlamento Europeo de septiembre de 2019, donde se trata de igualar nazi-fascismo y comunismo bajo el concepto falaz de totalitarismo, ha hecho del revisionismo histórico la plataforma desde la que desplegar todo su artillería legislativa contra los sectores más conscientes del movimiento obrero.


Con este nuevo paso de militante anticomunismo, Polonia acompaña lo andado ya en las repúblicas bálticas y la República Checa y, con meridiana claridad,ejemplifica que la pinza anticomunista de socialdemócratas y conservadores en la UE, lo único que hace es abrirle la puerta de par en par al fascismo en Europa.


Firmes en nuestro compromiso a favor de la lucha obrera y el Socialismo, manifestamos nuestra plena solidaridad con la militancia comunista polaca y su Partido.
